    JOB DESCRIPTION SUMMARY

    Assumes responsibility and provides leadership for current PL 638 trust programs administered under self-determination awards, develop, plan and implement goals and objectives to contract additional trust functions under self-determination contracts, participates in the resolution of critical and highly unusual problems, directs day to day activities of Residential Leasing staff; assigns work activities, projects and programs; foster teamwork.

    ESSENTIAL DUTIES AND RESPONSIBILITIES

    • Reviews and provides guidance to staff in the processing of residential lease title transfers that Includes examining lease titles and reviewing assignment documents for compliance with federal Indian and real estate title law
    • Develops checklists and provides advice to escrow and title companies, banks, law firms and real estate brokers in the processing of Indian land lease transactions
    • Provides analysis on rights of way applications and makes recommendations to the Superintendent based on highest and best use of land utilization and maximum benefit to the landowner. Makes recommendations to BIA Superintendent
    • Follows through with rights of ways to oversee that the applicant has complied with the terms of the document
    • Plans and coordinates the work of Trust Services Programs in accordance with the Tribe's self-determination contracts.
    • Evaluates the Program's progress toward meeting objectives and, as necessary, modifies plans to reflect changed goals.
    • Assists in identifying the overall long-range program objectives and is responsible for the presentation and justification of the long-range staffing plans needed to accomplish the Program objectives
    • Researches, analyzes and prepares a wide variety of reports including those covering new or complex issues, for changes in or implementation policies and procedures Prepare Staff Reports and Resolutions for Tribal Council approval
    • Represent the Tribe in the greater community and at professional meetings
    • Departmental budget preparation and control
    • Supervise and participate in the development and administration of the Trust Services Division budget; monitor and approve expenditures; estimate and anticipate annual revenues and assure proper collections; and implement mid-year adjustments.

    QUALIFICATION REQUIREMENTS (Knowledge and Abilities)

    • Strong knowledge of Bureau policies, practices and techniques in the management of Indian trust assets
    • Strong knowledge of contracts
    • Ability to research, analyze and summarize records from a variety of sources
    • Ability to interpret laws, policies and regulations to the special and diverse transactions and inquiries that are encountered in a normal days work
    • Knowledge and experience of administrative and management principles coupled with the ability to evaluate sound business proposals
    • Ability to resolve critical and highly unusual problems, developing new approaches or techniques to develop, preserve and protect trust resources
    • Insure that the realty transactions meet title standards and comply with laws, regulations and policies
    • Knowledge of the Tribe's mission, organization, function and objectives to carry out the Tribe's self-determination contracts
    • Knowledge of the Area, personnel policies and practices
    • Knowledge of FOIA
    • Knowledge and understanding of the ACIR
    • Knowledge of the BIA organization and functions, to carry out management functions of a variety of trust programs
    • Thorough knowledge and understanding of principles, practices and procedures related to trust länd transactions
    • Knowledge and understanding of the Code of Federal Regulations and Guidelines (CFR)
    • Knowledge of applicable federal, state, local laws, regulations, guidelines, codes, and policies related to easements, rights of entry, real estate title, and other right-of-way technical, legal and financial activities.
    • Ability to quickly research property issues, evaluate alternatives, and make sound written recommendations.
    • Ability to effectively represent the Tribe with governmental agencies; business, professional and regulatory bodies; as well as with property owners, developers, contractors and the general public.
    • Ability to interpreting, apply and explain lawsi codes, regulations and ordinances related to Indian land.
    • Ability to interpret legal descriptions of property and make appropriate decisions in accordance with laws, regulations and policies.
    • Thorough knowledge and ability to understand maps, surveys, and legal documents.
    • Ability to effectively and thoroughly research lends records resources
    • Ability to communicate effectively with officials, co-workers, subordinates, the general public:
    • representatives of organizations and others sufficient to exchange or convey information and receive work direction, both orally and in writing
    • Ability to effectively analyze administrative and technical problems and make sound policy and procedural recommendations to their solutions
    • Ability to prepare comprehensive reports
    • Maintain confidentiality of sensitive and privileged information
    • Knowledge of federal database (TAÅMS)
    Qualifications

    EDUCATION and/or EXPERIENCE

    Five years progressively responsible, relevant professional experience in Indian lease land transactions, a Bachelor's Degree in Business Administration (finance, real estate and law emphasis) and a minimum of two years in a supervisory capacity or possess the equivalent combination of education and experience.

    WORKING CONDITION'S/PHYSICAL DEMANDS

    To perform this job successfully: the individual must be able to stand, move and work throughout the office area and properties, including walking up to 1 4/2 miles, climbing stairs and sitting at a desk/work station for the duration of the shift, Also may be subjected to a smoke filled environment.

    Typically the individual will be housed in an office environment but may occasionally be exposed to outside weather conditions. The noise level in the work environment is usually moderate. Reasonable accommodation may be made to enable individuals with disabilities to perform essential functions. Must be able to grasp, bend, lift and/or carry or otherwise move goods weighing a minimum of 25 lbs. on an intermittent basis, and sufficient dexterity of hand in order to use office equipment including, but not limited to: a computer keyboard, calculator, general office equipment and multi-line telephone.
