  • Job Purpose: Examines titles to determine legal condition of property title: Examines copies of records, such as mortgages, liens, judgments, easements, vital statistics, and plat and map books to determine ownership and legal restrictions and to verify legal description of property. Copies or summarizes (abstracts) recorded documents, such as mortgages, deeds, and contracts affecting condition of title to property. Analyzes restrictions and prepares report outlining restrictions and actions required to clear title. This position is responsible for final policies and assisting with out of county orders.

    Duties:

    CORE DUTIES

    -Examine documentation in a chain of title as they pertain to the real property (i.e. mortgages, liens, judgments, easements, plat books, maps, contracts, and agreements in order to verify factors such as properties' legal descriptions, ownership, or restrictions.

    -Review of legal documents to be recorded to complete transactions. Including: deeds, CRV, partial releases, easements, Certificates of Trust, ect. - for accurate preparation, complete execution, notarization, correct legal description, grantor/grantees/trustees.

    -Verify accuracy and completeness of land-related documents accepted for registration; prepare rejection notices when documents are not acceptable.

    -Read search requests in order to ascertain types of title evidence required and to obtain descriptions of properties and names of involved parties.

    -Examine individual titles in order to determine if restrictions, such as delinquent taxes, will affect titles and limit property use.

    -Review of Surveys: look at survey to acknowledge encroaches of structures/driveways into setbacks/easements set forth in covenants/plats together with other platting regulations.

    -Prepare commitments describing any title encumbrances encountered during searching activities, and outlining actions needed to clear titles.

    -Confer with realtors, lending institution personnel, buyers, sellers, contractors, surveyors, and courthouse personnel in order to exchange title-related information or to resolve problems.

    -Enter into Escrow Vision tracking appropriate data needed to create new title records or update existing ones.

    -Answering Questions regarding completed searches, including providing status of orders to customers, Changing Loan Amounts, Purchasers Names

    -Provide quality “Customer Service” in all job related duties and customer interactions.

    -Place order for a Commitment or update when property is out of county.

    -Issue Commitments and Reports: Upon receipt of a search sheet, documents and name lien search, exam the title and determine requirements and exceptions to the title. If applicable, make additional search of the Secretary of State, bankruptcy or assessors records. Make sure all parties associated with this exam are listed properly on the Memorandum of Charges and are provided with a copy via email or delivery & make copies of additional documents (plat, covenants etc.) if required to accompany the Commitment. Make the determination of what premiums and associated fees are to be shown on the Memorandum of Charges. Customer Relations: Attend functions relating to work to interact with different associates (i.e. attend monthly meeting for the BH Homebuilders)

    ADDITIONAL DUTIES

    -Pay out of county companies for reports and countersignatures: Ability to determine correct amount due to each county.

    -Print off completed searches, checking status of incomplete orders, continually organizing files.

    -Assist with overflow of the rotational Pennington county orders as needed.

    Communicate with customers, field phone calls, emails etc. other employees can't handle, handle problems that arise
