Managing Attorney is responsible for managing the daily operations of a law firm or an organization's legal department. Provides leadership and participates in the most complex legal actions. Being a Managing Attorney directs law office operations, case assignments, and staffing. Oversees the activities and work products of subordinate attorneys. Additionally, Managing Attorney monitors case status, timelines, and issues. Mentors and coaches attorneys and implements staff professional development programs. Requires a JD. Requires State Bar membership. Typically reports to top legal executive. The Managing Attorney manages subordinate staff in the day-to-day performance of their jobs. True first level manager. Ensures that project/department milestones/goals are met and adhering to approved budgets. Has full authority for personnel actions. To be a Managing Attorney typically requires 5 years experience in the related area as an individual contributor. 1-3 years supervisory experience may be required.   • The Monongalia County Prosecutor’s Office is seeking an Assistant Prosecuting Attorney for misdemeanor domestic violence and/or child abuse and neglect cases. Under general direction, the Assistant Prosecuting Attorney will assess and prepare each case by reviewing the investigation, speaking with witnesses, and assessing any mitigating factors to resolve a case through trial or plea negotiations.

    Required Qualifications:

    • Applicants must be licensed to practice law in the State of West Virginia with no history of disciplinary action. Law Students awaiting bar exam results or scheduled to take the bar exam may be considered and/or hired contingent upon results.
    • Applicants must possess a combination of training and work experience which indicates possession of the knowledge, skills, and abilities listed below.

    Knowledge, Skills, and Abilities:

    • Experience working in a fast-paced legal environment preferred.
    • Experience or special interest in domestic violence and/or child abuse/neglect preferred.
    • Excellent communication skills, including the ability to communicate clearly with a wide range of people.
    • The ability to work well in a team setting.
    • The ability to handle sensitive information while preparing and presenting complex cases.
    • The ability to organize and present effective arguments in court, as well as to interview and cross-examine witnesses, victims, defendants, and law enforcement personnel.

    Job Duties:

    • Coordinate with advocates to provide services to victims and provide insight to those victims in the court process and procedures.
    • Meet with law enforcement officers, defense attorneys, judges, and court personnel to discuss and review cases.
    • Identify the impact of trauma and modify legal practices to enable traumatized witnesses to safely participate in proceedings.
    • Prepare cases for trial or plea negotiations by reviewing all evidence, facts, and communications with witnesses.
    • Effectively argue cases at trial and question and cross-examine witnesses.
    • Participate in pre=hearing conferences, issue subpoenas and other appropriate orders relating to the discovery process.
    • Prepare for and present evidence to grand juries.
    • Maintain records, consistently update case management system, and answer correspondences in a timely fashion.
    • Participate in internal and external conferences and meetings.
    • Serve as a liaison with other agencies and the community.
    • Independently research, interpret and apply legal and administrative principles to each case. Must stay informed concerning applicable law, rules, procedures, policies, and practices related to criminal law and the Monongalia County Prosecutor's Office.
    • Engage in continuing education, both legal and non-legal, to stay up to date on best practices and new ideas.
