1. A Juris Doctorate from an ABA accredited institution,
2. Attorney in good standing with, and licensed by, the West Virginia State Bar,
3. Administrative/managerial work to include at least 5 years of service within a senior management position within a West Virginia Public School system,
4. Criminal background check per WV Code §18A-5-15c and/or §18A-3-10, as appropriate
5. Ability to perform the job duties set forth below.

Provides legal representation, legal advice, interpretation, and guidance to Superintendent and Board regarding personnel matters, contracts, state and federal regulatory requirements, policy development, and all other legal matters.

1. Serves as In House Counsel by providing legal representation to the Superintendent, Board, and staff members acting in their official capacity.
2. Reviews all information and prepares defense for any legal actions against the Board and/or Superintendent.
3. Advises the Board and/or Superintendent on the prosecution of any lawsuits or legal claims on behalf of the organization.
4. Provides input to the strategic decisions that affect the functional area of responsibility.
5. Provides guidance on parliamentary procedure to the Board.
6. Advises Superintendent on all legal matters.
7. Advises Superintendent and/or Board on matters of student discipline.
8. Provides basic legal services such as:
A. Writing and/or reviewing contracts
B. Managing all grievances through all levels of the process.
C. Representing the BOE in unemployment claims.
D. Reviewing and fulfilling Freedom of Information Act Requests
E. Reviewing and complying with all Subpoenas to ensure compliance with FERPA.
F. Reviewing and preparing deeds, easements, and right of ways.
G. Providing the Board with legal advice regarding the Open Meetings Act, Parliamentary Procedure, and general questions of law.
H. Providing legal advice to staff regarding their official duties
9. Advises Superintendent on all employee discipline/Grievances by:
A. Ensuring adequate, legal, and fair investigation.
B. Preparing all notices as required by law.
C. Composing all employee discipline letters
D. Organizing employee hearings
E. Preparing Level I Decisions
10. Oversees and monitors all investigations to ensure compliance with law and policy.
11. Maintains and updates policies and procedures.
12. Coordinates all mandatory training for staff.
13. Ensures District and Board compliance with all state and federal laws and regulations.
14. Performs other duties as assigned by the Superintendent.

2. Skill in preparing documents and composing fiscal letters and memoranda.
3. Skill in establishing and maintaining effective working relationships with executive staff, School Board, management, government agencies and the public.
4. Skill in working with considerable independence to conduct tasks to completion.
5. Skill in performing duties with a professional and cooperative work ethic; ability to maintain confidentiality.
6. Ability to work flexible hours necessary for the efficient operation of the department.
7. Expert knowledge of the terminology, job content and qualification requirements of a variety of occupations.
8. Considerable knowledge of recent developments, current literature, and informational resources in the field of public education.
9. Expert knowledge of state and federal laws and regulations governing Public Education, Personnel and Human Resource administrative policies and procedures.
10. Expert knowledge of basic School District work policies and guidelines.
11. Expert knowledge of departmental practices and procedures.
