In general, the Clerk of Court is responsible for the intake and filing of new litigation and administration of the docket of litigation pending before the Court in a manner that encourages the timely and efficient resolution of cases within 120 days of filing and avoid unnecessary backlog or unreasonable delay. Specifically, the Clerk opens new files and maintains filings in the Spartan case management system. For Protected Persons and Trust Litigation: The Clerk receives, reviews, files and scans pleadings, actions to restore capacity and terminate guardianship/conservatorship, motions for emergency/temporary relief, applications for relief, petitions for appointment of successor guardian/conservator, affidavits/certificates of service/, responsive pleadings, affidavits of default, guardian ad litem and examiner reports, restricted account agreements/bond, SLED/Credit reports, notices of hearing, and proposed orders submitted by counsel. The Clerk will draft Orders appointing counsel, guardian ad litem, and examiner. The Clerk is responsible for confirming service of pleadings, motions, and notice of hearing on all interested parties in accordance with Rule 4, SC Rules of Civil Procedure. The Clerk must understand and apply the Court Rues and Rules of Civil Procedure concerning electronic signatures and electronic service. The Clerk of Court may draft, file, and serve Rules to Show Cause and Summons and provide judicial assistants support with the same. The Clerk of Court will timely schedule hearings during regular court sessions at convenient times to accommodate citizens, attorneys, and departments that routinely participate in the Court system. The Clerk must have a working knowledge of zoom and other video platforms to schedule video hearings as needed. The Clerk is responsible for interacting and communicates effectively and cordially with staff, co-workers, attorneys, paralegals, judges, other agencies and citizens regarding all litigation procedures, pleadings, documents, complaints and requests, and must exemplify excellent customer service techniques in listening, effectively communicating, and problem solving. The Clerk will serve as administrative assistant to the assigned Judge, prepare and maintain a calendar of various meetings, appointments and court hearings, coordinate scheduling of Court Reporter, interpreter, or other individuals as needed, draft legal documents for Judge's signature; and process legal documents according to division operations, within designated timeframes established by SC law and according to office procedures. Performs other related duties as required and assigned. Associate degree in Paralegal, Business Administration, or a related field required; supplemented by one year of experience in a court or legal environment; or any equivalent combination of education, training, and experience which provides the requisite knowledge, skills, and abilities for this job. Must possess and maintain a valid South Carolina Driver's License. May be required to possess and maintain Paralegal and/or other certification(s) according to area of assignment.
